Title to Products, Import & Export of Products

Title of our products passes to customers upon delivery. All risks of loss of or damage to our products while in customers’ possession shall be borne by customers absolutely. We deliver customer’s order of our products to customers or to the order of customers under customers’ instructions. If we are asked to deliver customers’ order to any country or city outside Hong Kong, customers may be required to pay customs duties, taxes and other levies, or to obtain certain license, permit and clearance or apply for registration of customers’ purchased products according to the applicable local rules, regulations and other requirements at the delivery destination or stopover or transfer point.

Customer are required to pay customs duties, taxes and other levies, and other fees or charges, to obtain license, permit and clearance, and to comply with the applicable local registration requirements, rules, regulations and other requirements shall be imposed by and determined according to the relevant local government, enforcement and/or regulatory authorities at the delivery destination, stopover or transfer point which are completely beyond our control.  We shall not assume the aforesaid customers’ obligations nor shall we accept any liability or responsibility in any circumstances for any customers failing to observe or abide by any such customers’ obligations or any applicable local laws, rules, regulations and other requirements at the delivery destination, stopover or transfer point.

If any customers’ order of our products is seized by any relevant local government, enforcement and/or regulatory authorities at the delivery destination, stopover or transfer point, it is at all times the customers’ obligation at their own cost and expense and in their sole discretion whether to discharge their customs clearance and seizure clearance with or to answer the relevant requisitions raised by the relevant local government, enforcement and/or regulatory authorities.  In any event, such customers shall be solely responsible for all losses, liabilities, and consequences whatsoever howsoever arising from or in relation to our delivery of the customers’ order of our products under the customers’ instructions.  

By placing and completing the customers’ order form with us, the customers acknowledge receipt of and irrevocably agree to be bound by the terms and conditions set out in our website and therein, and to be responsible to pay customs duties, taxes and other levies, or to obtain certain license, permit and clearance or apply for registration of customers’ purchased products according to the applicable local rules, regulations and other requirements at the delivery destination or stopover or transfer point.  If any product package is under any circumstances rejected and returned to us, title to such returned products shall be automatically reverted or is otherwise deemed to have been assigned or transferred to us, in which event, you shall still be liable to pay for the return shipping charges and an administrative and handling fee at the rate of [10%] on such returned product purchase price.

In the event that any of our disclaimers set out herein is not enforceable, our liability in aggregate for losses or damages whatsoever to you shall not exceed the amount that you paid to us for such particular service or product upon which liability is based.

We may at any time terminate or suspend your access to this website wholly or in any part thereof without prior notice for any conduct that we may in our absolute and sole discretion consider that you are or have been in violation of these Terms of Use and/or any applicable law, statute or regulation.

Pricing

Prices are shown on the Site in American Dollars (USD) in Hong Kong. Prices displayed on the Site at the time your order is accepted will be honored except in the case of obvious error. Whilst we use our best endeavors to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or canceling your order. If we are unable to contact you, we will treat the order as canceled.

If your credit/debit card is not denominated in American Dollars (USD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

Taxes and duties applicable to your order depending on the shipping country of your order:

1. Hong Kong orders are not subject to taxes and duties.
2. Customers placing orders from countries served on a Delivery Duty Unpaid (DDU) basis will only be charged for the price of the product(s) purchased (excluding taxes and duties) and the delivery costs. Customers will be responsible for the payment of all import tax and duties levied by the country to which the products are shipped and payment of the said tax and duties is necessary for the release of the products ordered from the Customs on arrival. Our couriers, SF Express, FedEx or UPS, will contact customers about the details of any import duty to pay. We advise you to contact your local customs authority to determine the cost of import tax and duties of your order prior to your placing orders with us.

Terms of Sale

In order to contract with Brazen Workshops., you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. We retain the right to refuse any request made by you, and we reserve the right to close your account at its sole discretion. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Brazen Workshop. or may in some cases be a third party. Where a contract is made with a third party we are not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Websites may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.

I. Our Contract

When you place an order, you will receive an acknowledgment e-mail confirming receipt of your order. This email will only be an acknowledgment and will not constitute acceptance of your order. Contract for the purchase of the goods has not be formed until your payment was approved and we have debited your credit or debit card.

II. Pricing and Availability

A. Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as canceled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly where applicable and included in the ‘Total Cost’.

B. The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We, therefore, reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

 III. Payment

Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorizing check has been completed. Your card will be debited once the order has been accepted.
